Choosing Support
What should a small or midsize RIA look for in a compliance consultant?
Look for experience with firms that have a similar business model, investment approach and regulatory position. Ask who will perform the work, how responsibilities will be divided and what support is included between scheduled reviews. A useful proposal should explain the tasks, deliverables and communication arrangements. Before comparing fees, make sure you are comparing similar scopes of work and levels of involvement.
How is broker-dealer compliance consulting different from RIA compliance consulting?
The engagement should reflect the firm's actual activities rather than apply the same checklist to every business. A broker-dealer may need particular attention to supervision, registered personnel, branches and securities distribution. An RIA may need a different mix of advisory disclosures, conflicts reviews and investment-related controls. Firms conducting both businesses should clarify how the consultant will coordinate the work across them.
Should we hire an internal CCO or use outsourced compliance support?
Consider the workload, complexity, management access and amount of daily involvement the position requires. Some firms need an internal CCO supported by outside specialists; others may consider an outsourced appointment. Compare the practical availability, expertise and authority of the proposed arrangement. The discussion should establish who makes decisions, who completes recurring tasks and how unresolved issues reach senior management.
Can a consultant support our current CCO without replacing them?
Yes. Additional consulting support can address a defined project, a recurring workload or an area where the internal team needs specialist input. Examples include reviewing documentation, organizing testing, preparing training or assisting with examination requests. The engagement should state which tasks remain with your CCO, what the consultant will deliver and how findings and decisions will be documented.

What should a compliance gap assessment deliver?
A useful assessment should move beyond a list of observations. Agree on the areas to be reviewed, the records and interviews required, and the form of the final output. Ask for findings that distinguish urgent issues from longer-term improvements, along with proposed actions, responsible owners and priorities. Clarify whether implementation support and a follow-up review are included or would be separate work.
What should we expect from ongoing compliance consulting?
The engagement should identify recurring tasks, the review calendar, communication arrangements and the records you will receive. Depending on scope, those records might include a status report, review findings, updated documents, training materials or a list of open actions. Ask how new business activities, examination requests and work outside the agreed scope will be handled. Avoid assuming every service is included in a retainer.

Examinations and AML
How can a consultant help us prepare for a regulatory examination?
Preparation can include reviewing the program, organizing supporting records, identifying unresolved issues and establishing an approach to requests and interviews. Start by agreeing on the business areas and documents to be reviewed. Ask how the consultant will present findings and support follow-up actions. Examination preparation should make the firm's records and responsibilities easier to understand; it cannot promise a particular examination outcome.
What information should we bring to an initial call after receiving an examination notice?
Bring the notice, deadlines, requested business areas, a short description of your firm and the names of the people coordinating the response. Explain any known documentation gaps or overlapping commitments. An introductory call can establish the work needed and whether the proposed support fits the timeline. Arrange a secure method for transferring confidential records rather than putting them into an initial website inquiry.
What should a broker-dealer discuss before engaging an independent AML reviewer?
Discuss the firm's activities, customers, onboarding process, systems and any relevant prior findings. Ask the reviewer to explain the proposed scope, evidence requests, testing approach and report format. Address independence and potential conflicts before work begins, including any involvement in designing or operating the program being reviewed.

What should a transition between compliance consultants cover?
A transition should account for open findings, approaching deadlines, current documents, system access and work already underway. Identify the owner of each task during the handoff and clarify the outgoing provider's obligations under its agreement. If the CCO appointment will also change, address that separately from the transfer of consulting work. Ask the incoming provider how it will assess priorities before taking over recurring tasks.
